1. Purpose
This Subscription, Billing, Cancellation & Refund Policy explains the terms applicable to SpinVisor subscriptions, including:
- Basic, Pro and Premium subscription tiers;
- monthly and annual billing;
- recurring payments;
- subscription renewals;
- preferred billing dates;
- billing-date changes;
- failed payments and payment retries;
- cancellation;
- refunds;
- subscription reactivation;
- account deletion; and
- mandatory consumer rights.
SpinVisor is operated by Dynemetry (Pty) Ltd, South Africa.
This Policy should be read together with the SpinVisor Terms of Service, Privacy Policy and other applicable SpinVisor policies.
2. Subscription Tiers
SpinVisor may offer the following subscription tiers:
Basic
Basic is a free subscription tier.
No recurring subscription payment is required to maintain a Basic account.
Basic functionality and limits may differ from those available through paid tiers.
Pro
Pro is a paid subscription tier providing access to additional SpinVisor functionality.
Current planned pricing:
Monthly: USD $9.99
Annual: USD $96.99
Premium
Premium is a paid subscription tier providing access to additional or expanded SpinVisor functionality.
Current planned pricing:
Monthly: USD $14.99
Annual: USD $143.99
Premium may not be available in every market or at every stage of SpinVisor's operation.
The price presented to the customer during checkout is the applicable transaction price.
3. Currency
Unless otherwise stated during checkout, SpinVisor subscription prices are displayed in United States dollars (USD).
A user's bank, card issuer or payment provider may:
- convert the transaction into another currency;
- apply its own exchange rate;
- impose international transaction fees; or
- impose other payment-related charges.
Third-party banking or currency-conversion charges are not controlled by SpinVisor.
4. Taxes
Subscription charges may be subject to applicable:
- VAT;
- sales tax;
- GST;
- digital-services taxes; or
- other taxes.
Applicable taxes may be included in the displayed price or added during checkout according to the applicable jurisdiction and tax requirements.
The final amount payable will be displayed before the user confirms the transaction.
5. Payment Processing
SpinVisor uses authorised third-party payment infrastructure to process subscription payments.
Dynemetry (Pty) Ltd and SpinVisor manage the commercial subscription relationship, including subscription status, billing rules, cancellation and applicable refund administration.
Payment gateways, acquiring institutions, banks and other payment service providers may process payment transactions on SpinVisor's behalf.
SpinVisor does not intend to store:
- complete payment-card numbers;
- CVV/card security codes;
- online-banking passwords; or
- equivalent sensitive payment credentials.
Payment providers may process payment information according to their own applicable terms and privacy requirements.
6. Subscription Activation
A paid subscription becomes active after:
- the applicable transaction has been successfully authorised or completed;
- SpinVisor receives the required payment confirmation; and
- the applicable paid subscription tier has been activated.
Where immediate access is selected and legally permitted, Pro or Premium functionality may become available immediately after successful payment.
SpinVisor may retain records necessary to establish:
- subscription consent;
- payment confirmation;
- subscription activation;
- applicable terms and policy versions; and
- legally required checkout acknowledgements.
7. Immediate Commencement of Services
Where permitted by applicable law, SpinVisor may offer immediate commencement of a paid subscription.
Where legally required, the checkout process may require the user to expressly request and consent to immediate commencement of the service before payment is completed.
Any effect that immediate commencement has upon a statutory cooling-off or withdrawal right will be determined according to the law applicable to that transaction.
SpinVisor will not represent a statutory cancellation or refund right as waived or excluded where applicable law does not permit that result.
8. South African Immediate-Access Transactions
For qualifying South African electronic transactions, SpinVisor may request the consumer's express consent for paid subscription services to begin immediately following successful payment.
Where the conditions of section 42(2)(d) of the Electronic Communications and Transactions Act 25 of 2002 (“ECTA”) are satisfied, the cooling-off provisions in section 44 may not apply to services that began with the consumer's consent before the applicable cooling-off period ended.
Where this exclusion is relied upon, SpinVisor will seek to obtain express consent before commencing the paid service and will maintain appropriate transaction records.
Where section 44 applies notwithstanding the above, SpinVisor will honour the consumer's applicable statutory rights.
9. No Voluntary Cooling-Off Programme
SpinVisor does not provide an additional voluntary cooling-off period beyond rights required by applicable law.
SpinVisor also does not ordinarily provide voluntary refunds merely because a user:
- changes their mind;
- no longer wishes to use SpinVisor;
- uses SpinVisor less than expected;
- stops gambling;
- changes casino or game preferences; or
- chooses to cancel a subscription before the end of an already-paid subscription period.
Mandatory consumer rights remain unaffected.
10. Monthly Subscriptions
Monthly subscriptions operate according to the user's subscription billing cycle and not according to calendar months.
For example, a monthly subscription beginning on 22 August would ordinarily cover the period from 22 August through 21 September, with the next billing cycle beginning on 22 September.
Unless cancelled or otherwise terminated, monthly subscriptions automatically renew according to the recurring billing arrangement disclosed during checkout.
11. Annual Subscriptions
An annual subscription provides access to the applicable paid tier for the annual subscription period.
Annual pricing may include a discount compared with purchasing twelve individual monthly subscription periods.
Unless cancelled or otherwise terminated, an annual subscription may renew for a further annual period where the user has authorised recurring renewal.
SpinVisor will provide applicable renewal information and notices as required by law.
12. Preferred Billing Date
SpinVisor may allow users to select a preferred recurring billing date.
This functionality is intended to allow users to align recurring subscription payments with a date that is more convenient for them.
Selecting a preferred billing date does not provide free additional subscription time.
Where changing or selecting the preferred date creates an additional subscription period that has not already been paid for, SpinVisor may charge a prorated amount for that period.
The exact amount will be disclosed before the user confirms the billing-date arrangement.
13. Monthly Billing-Date Changes
A monthly subscriber may be permitted to change their preferred recurring billing date.
A customer-initiated billing-date change may ordinarily be made no more than once during a six-month period.
Where the change extends the existing paid period before the new recurring date begins, SpinVisor will calculate an applicable prorated bridge charge.
The user will be shown:
- the current paid-through date;
- the requested new recurring billing date;
- the bridge period;
- the applicable prorated amount;
- the next regular subscription amount; and
- the date on which regular recurring billing will resume
before confirming the change.
Administrative corrections made by SpinVisor to resolve a billing error are not subject to the customer billing-date-change limit.
14. Annual Preferred Billing Dates
SpinVisor may allow annual subscribers to select a preferred future annual renewal date.
A preferred annual billing date must not be used to shorten the subscription period for which the annual discounted price was calculated.
Where alignment with the preferred renewal date requires an additional bridge period beyond the original annual term, that additional period may be charged on a prorated basis.
Any prorated annual bridge calculation will take account of the applicable annual subscription pricing rather than automatically applying the monthly subscription rate.
The applicable period, calculation and amount will be disclosed before the user confirms the arrangement.
Where possible, a preferred annual billing date may be selected during the original subscription process.
Changes requested after the annual subscription has commenced will ordinarily be implemented in connection with the next annual renewal rather than shortening the existing annual term.
15. Cancellation of Automatic Renewal
Users may cancel the automatic renewal of a paid subscription through the subscription-management functionality made available by SpinVisor.
SpinVisor will not intentionally require a user to telephone SpinVisor or complete an unnecessarily burdensome cancellation process merely to stop automatic renewal.
A normal cancellation of automatic renewal does not, by itself, create a refund entitlement.
16. Monthly Cancellation
Unless mandatory applicable law requires otherwise, cancelling a monthly subscription:
- stops the next recurring renewal;
- does not reverse the current completed subscription payment;
- does not result in a voluntary refund;
- allows the user to retain the applicable paid tier until the end of the already-paid monthly period; and
- causes the account to return to Basic when that paid period expires.
For example:
A Premium Monthly subscription purchased on 22 August ordinarily remains active through 21 September.
If the user cancels on 2 September, Premium remains available through 21 September, no renewal occurs on 22 September, and the account ordinarily becomes Basic from 22 September.
17. Annual Cancellation
Unless mandatory applicable law requires otherwise, cancelling automatic renewal of an annual subscription:
- stops the next annual renewal;
- does not reverse the completed annual payment;
- does not ordinarily result in a voluntary refund for unused months;
- allows the user to retain the applicable paid tier until the end of the already-paid annual term; and
- causes the account to return to Basic when that annual term expires.
Where applicable consumer law provides a statutory right to terminate a fixed-term agreement before its normal expiry, SpinVisor will apply that right.
18. Mandatory Consumer Cancellation Rights
Nothing in this Policy removes, restricts or replaces a mandatory consumer right.
Depending on the applicable jurisdiction and transaction, consumers may have statutory rights relating to:
- cooling-off periods;
- withdrawal;
- cancellation;
- termination of fixed-term agreements;
- defective or non-conforming services;
- refunds;
- credits; or
- other remedies.
Where mandatory law conflicts with SpinVisor's standard no-voluntary-refund policy, the mandatory law will prevail.
19. Mandatory Full Refunds
Where applicable law requires SpinVisor to provide a full monetary refund following cancellation or withdrawal, SpinVisor will honour that requirement.
Where such a full refund terminates or unwinds the paid subscription, Pro or Premium access will end when the applicable statutory cancellation or termination becomes effective.
The user will not ordinarily retain the refunded paid subscription for the remaining original billing period unless applicable law requires otherwise.
A statutory monetary refund will not be replaced with store credit, merchandise credit or another non-monetary benefit where applicable law requires money to be refunded.
20. Refund Method
Approved monetary refunds will ordinarily be returned through the same payment method or payment account used for the original transaction.
SpinVisor will not ordinarily redirect a refund to an unrelated card, bank account or other payment destination at the user's request.
Where the original payment method cannot receive a refund, the authorised procedures of the applicable payment provider will apply.
Processing and settlement times may vary according to the payment method, bank, card network or payment provider.
21. South African Fixed-Term Consumer Rights
Where section 14 of the South African Consumer Protection Act 68 of 2008 applies to a SpinVisor fixed-term consumer agreement, SpinVisor will respect the consumer's statutory cancellation rights.
Where applicable, this may include the consumer's right to cancel a qualifying fixed-term agreement by giving the notice required by law.
The consumer may remain liable for amounts lawfully owed up to the effective date of cancellation, and SpinVisor may apply a reasonable cancellation charge where and to the extent permitted by law.
Any amount that must legally be credited or refunded to the consumer will be handled according to the applicable statutory requirements.
SpinVisor's standard annual no-voluntary-refund policy does not override these rights.
22. Subscription Renewal Notices
SpinVisor will provide subscription-renewal notices where required by applicable law.
SpinVisor also intends to provide advance annual renewal information as part of its subscription-management process.
A renewal notice may include:
- current subscription tier;
- renewal date;
- renewal price;
- applicable taxes where known;
- payment-method identifier where appropriate;
- instructions for managing the subscription; and
- instructions for cancelling renewal.
Jurisdiction-specific notification periods will be applied where legally required.
23. Payment Processing Dates
A subscription's contractual renewal date and the date on which a payment network submits, processes or settles a transaction may not always be identical.
Processing may be affected by:
- the selected payment method;
- banking days;
- weekends;
- public holidays;
- payment-network requirements;
- banking-system requirements; and
- gateway processing rules.
SpinVisor will seek to process recurring payments consistently with the agreed subscription arrangement and applicable payment mandates.
SpinVisor will not intentionally create undisclosed early recurring charges merely because a renewal date approaches.
24. Failed Renewal Payments
If a recurring subscription payment fails, SpinVisor may temporarily place the subscription into a payment-recovery period.
SpinVisor will not intentionally make repeated uncontrolled collection attempts.
The standard automated recovery process may consist of a maximum of three total payment attempts:
- the original scheduled renewal attempt;
- a second attempt approximately three working days after the original failed attempt; and
- a final attempt approximately three working days after the second failed attempt.
Actual processing dates may be adjusted where banking days, public holidays, payment-network requirements or applicable law require a different processing date.
25. Failed-Payment Notifications
SpinVisor will notify the user when a recurring subscription payment fails.
Where appropriate, the notification may identify:
- the unsuccessful payment;
- amount due;
- subscription tier;
- original renewal date;
- next scheduled payment attempt;
- payment status;
- a secure payment link;
- a method for updating payment details;
- an available billing-date-change option; and
- the consequences if payment remains unsuccessful.
SpinVisor will seek to give the user an opportunity to resolve the payment problem before the final automated attempt.
26. Paying an Outstanding Renewal Manually
A user may be able to resolve an unsuccessful renewal payment before the next automated attempt by using an authorised SpinVisor payment link.
Where available, the payment process may also allow the user to select or change their preferred future billing date.
This allows a user whose previous renewal date was inconvenient to align future recurring payments with a more suitable date.
Any:
- prorated adjustment;
- bridge period;
- revised billing date;
- amount payable; and
- next recurring payment date
will be shown before the user confirms the change.
A billing-date change made through payment recovery is subject to SpinVisor's applicable billing-date-change rules unless SpinVisor authorises an administrative exception.
27. Final Failed Payment
If the final permitted automated payment attempt is unsuccessful, the affected paid subscription may be suspended or terminated.
The user will not automatically be moved from Premium to Pro or from one paid tier to another paid tier.
Instead, the account will ordinarily return to the free Basic tier.
SpinVisor will notify the user that the paid subscription is no longer active.
No further automatic collection attempts will ordinarily be made against the terminated failed subscription unless the user subsequently authorises a new payment or subscription arrangement.
28. Bank and Third-Party Failure Fees
A user's bank, card issuer or other payment institution may impose its own:
- insufficient-funds fees;
- dishonour fees;
- declined-payment fees; or
- similar charges.
Such charges are determined by the relevant financial institution and are not received by SpinVisor.
SpinVisor nevertheless seeks to reduce avoidable repeated payment attempts by limiting its standard automated recovery process as described in this Policy.
Users experiencing recurring payment timing problems are encouraged to use an available preferred-billing-date option or update their payment arrangements before the next scheduled attempt.
29. Return to Basic After Payment Failure
Termination of a paid subscription because of payment failure does not ordinarily delete the user's SpinVisor account.
The account returns to Basic and remains subject to the functionality and limits of the Basic tier.
The user may subsequently purchase a new Pro or Premium subscription.
SpinVisor does not ordinarily charge the user retrospectively for months during which the account operated only on Basic.
30. Reactivating a Paid Subscription
A former paid subscriber may reactivate or purchase an available paid subscription at a later date.
Unless otherwise required by law or expressly disclosed, the new paid subscription begins from the new activation date and does not create charges for the intervening period during which the account operated on Basic.
For example, if a Pro subscription ends because of payment failure and the user remains on Basic for six months, SpinVisor will not ordinarily charge six months of Pro fees as arrears merely because the user later subscribes to Pro again.
31. Historical Data and Subscription Tiers
A subscription downgrade or payment failure does not, by itself, mean that historical gameplay data has been deleted.
SpinVisor may retain account-linked historical information in accordance with the Privacy Policy and applicable retention rules.
Access to historical information depends on the functionality and limits of the user's current subscription tier.
Current planned paid-tier history limits include:
- Pro: access to up to 6 months of eligible historical data; and
- Premium: access to up to 24 months of eligible historical data.
Basic may provide a more limited history view.
Historical data outside the period accessible through the user's current subscription tier may remain retained by SpinVisor but will not necessarily be accessible through that tier.
Upgrading or reactivating an eligible subscription may restore access to retained historical information falling within the history period available to that subscription tier.
Subscription downgrade or payment failure should therefore not be interpreted as confirmation that inaccessible historical information has been deleted.
32. Cancellation Is Not Account Deletion
Cancelling a subscription does not delete the user's SpinVisor account.
When paid access expires, the account ordinarily remains available as Basic.
Subscription cancellation does not, by itself:
- delete the user's profile;
- delete account-linked information;
- anonymise historical gameplay data; or
- trigger SpinVisor's account-deletion process.
Account deletion is a separate user action.
33. Account Deletion
Users may request permanent deletion of their SpinVisor account independently of subscription cancellation.
Before the deletion is executed, SpinVisor will provide a clear confirmation explaining that account deletion is permanent and irreversible.
The user may be required to expressly confirm that they understand the Account Deletion Terms before the final deletion action becomes available.
Where the user confirms deletion:
- account access ends;
- remaining Pro or Premium access ends;
- the account cannot subsequently be restored;
- account-linked personal information will be handled according to the Privacy Policy and applicable law;
- historical gameplay information retained for statistical purposes will be irreversibly anonymised according to SpinVisor's applicable anonymisation process; and
- previously associated history cannot later be reconnected to a newly created account.
Voluntary account deletion does not, by itself, create a right to a subscription refund.
Mandatory statutory rights remain unaffected.
34. Service Problems
Where paid SpinVisor functionality materially fails to conform to applicable contractual or legal requirements, users may have remedies under applicable consumer law.
Depending on the circumstances, those remedies may include:
- correction of the service;
- restoration of functionality;
- an appropriate price adjustment;
- termination;
- credit; or
- refund
where required by applicable law.
This section does not create a voluntary refund programme beyond SpinVisor's legal obligations.
35. Unsupported Casinos, Games and Providers
SpinVisor does not support every:
- casino;
- game;
- game provider;
- website;
- jurisdiction; or
- browser environment.
Users should review current compatibility information where compatibility is material to their subscription decision.
Information identifying supported casino websites is provided as technical compatibility information and does not constitute a recommendation or endorsement of a casino operator.
Applicable mandatory consumer remedies remain unaffected.
36. Third-Party Technical Changes
SpinVisor operates in technical environments that may also involve websites, games, browsers and infrastructure controlled by third parties.
Functionality may be affected by changes made by:
- casino operators;
- game providers;
- browser developers;
- extension platforms;
- infrastructure providers; or
- other third parties.
SpinVisor does not guarantee permanent compatibility with every third-party technical environment.
Where a material service problem gives rise to mandatory consumer rights, those rights remain unaffected.
37. Subscription Pricing Changes
SpinVisor may change subscription pricing.
A price change will not ordinarily alter a subscription period that has already been paid.
Where a recurring subscription price will change for a future billing period, SpinVisor will provide applicable notice as required by law.
Where renewed consent is legally required, SpinVisor will obtain that consent.
A user who does not wish to continue at the new price may cancel future renewal before the new price becomes applicable.
38. Promotional Pricing and Discounts
SpinVisor may offer promotional or discounted subscription pricing.
Promotional offers may contain additional disclosed conditions concerning:
- eligibility;
- duration;
- subscription tier;
- expiry;
- renewal pricing; and
- other applicable limitations.
Annual subscriptions may be priced at a discount compared with purchasing twelve monthly periods.
The existence of a discount does not remove mandatory consumer cancellation rights.
39. Subscription Feature Changes
Features available through Basic, Pro and Premium may evolve over time.
SpinVisor may:
- introduce functionality;
- modify functionality;
- remove functionality;
- adjust usage limits;
- change historical-access limits; or
- reorganise subscription tiers.
Material changes affecting an existing paid subscription will be handled according to the Terms of Service and applicable consumer law.
Nothing in this section removes mandatory remedies available where a paid service fails to conform to applicable legal or contractual requirements.
40. Gambling Activity Does Not Determine Subscription Charges
SpinVisor subscription charges are not calculated according to:
- casino wins;
- casino losses;
- amount wagered;
- number of spins;
- casino deposits;
- casino withdrawals; or
- gambling profitability.
SpinVisor does not take a percentage of casino winnings or losses.
Subscription charges relate to access to the applicable SpinVisor subscription tier.
41. Casino Accounts Are Separate
A SpinVisor subscription is separate from the user's relationship with any casino operator.
Cancelling SpinVisor does not:
- close a casino account;
- self-exclude the user from gambling;
- stop casino deposits;
- withdraw casino funds;
- cancel casino promotions; or
- change casino account settings.
Similarly, closing, restricting or self-excluding from a casino account does not automatically cancel a SpinVisor subscription.
Users should separately manage their SpinVisor subscription where necessary.
42. Subscription and Transaction Records
SpinVisor may retain limited subscription and transaction information including:
- subscription tier;
- billing interval;
- subscription start and end dates;
- preferred billing date;
- renewal status;
- cancellation status;
- payment status;
- failed-payment attempts;
- payment-provider customer or subscription identifiers;
- transaction or order references;
- payment consent records; and
- applicable policy or checkout-consent versions.
Accounting, tax and transaction records may be retained for periods required by applicable law.
SpinVisor does not intend to store complete card details or equivalent sensitive payment credentials.
43. Payment Disputes and Chargebacks
Users who believe a payment was:
- duplicated;
- incorrect;
- unauthorised;
- collected after an effective cancellation; or
- otherwise processed incorrectly
should contact SpinVisor promptly.
SpinVisor will investigate the applicable subscription and payment records.
Nothing in this Policy prevents a consumer from exercising a lawful chargeback, payment-dispute or statutory consumer right.
Fraudulent or abusive payment disputes may result in account restrictions or other action permitted by law.
SpinVisor will not treat the legitimate exercise of a consumer's statutory rights as abuse.
44. Changes to This Policy
SpinVisor may update this Policy where:
- subscription plans change;
- pricing changes;
- payment infrastructure changes;
- tax arrangements change;
- billing functionality changes;
- consumer-law requirements change; or
- SpinVisor's subscription practices otherwise change.
The “Last Updated” date will be revised when this Policy changes.
Material changes will be communicated where required by applicable law.
Changes will not retrospectively remove mandatory consumer rights.
