1. Purpose

This Gambling & Analytics Disclaimer explains important limitations concerning the gameplay information, statistics, analytics and community information made available through SpinVisor.

SpinVisor is operated by Dynemetry (Pty) Ltd, South Africa.

By using SpinVisor, users acknowledge that SpinVisor is an analytical and gameplay-tracking service and is not a gambling operator, casino, bookmaker, gambling adviser or gambling decision-making service.

This Disclaimer should be read together with the SpinVisor Terms of Service and Responsible Gambling & Player Safety Policy.

2. SpinVisor Is an Analytics Service

SpinVisor provides tools that may record, calculate, display or analyse information concerning gameplay.

Depending on the applicable functionality, this may include:

  • gameplay sessions;
  • spins and game events;
  • wager amounts;
  • wins and losses;
  • profit/loss information;
  • observed RTP;
  • winning-spin rates;
  • average wagers;
  • average wins;
  • tumble or cascade activity;
  • multipliers;
  • bonus and feature activity;
  • purchased and naturally triggered features;
  • dry spells;
  • session performance;
  • historical gameplay patterns;
  • variance-related statistics;
  • game and provider information;
  • community statistics; and
  • other gameplay-derived metrics.

This information is provided for informational, analytical and record-keeping purposes.

3. SpinVisor Does Not Recommend Bets

SpinVisor does not provide:

  • suggested wager amounts;
  • instructions to increase a wager;
  • instructions to decrease a wager;
  • instructions to maintain a particular wager;
  • recommendations concerning what amount a user should gamble;
  • predictions that changing a wager will improve the likelihood of winning; or
  • instructions to continue gambling because of previous gameplay results.

SpinVisor does not make wagering decisions on behalf of users.

4. SpinVisor Does Not Decide Whether You Should Gamble

SpinVisor does not decide or recommend:

  • whether a user should gamble;
  • whether a user should continue gambling;
  • whether a user should stop gambling;
  • which casino a user should use;
  • which game a user should play;
  • what amount a user should wager;
  • whether a user should purchase a bonus or feature; or
  • whether a particular gambling opportunity should be pursued.

Any decision to gamble, continue gambling, stop gambling, select a game, select a casino, place a wager or purchase a feature remains the user's own decision.

5. SpinVisor Does Not Place Wagers

SpinVisor does not:

  • initiate casino wagers on behalf of users;
  • initiate spins on behalf of users;
  • purchase casino features on behalf of users;
  • make casino deposits on behalf of users;
  • withdraw casino funds on behalf of users; or
  • control the user's casino account.

The user remains responsible for all gambling actions performed through the applicable casino or gambling service.

6. Gambling Outcomes Are Uncertain

Gambling involves financial risk.

Past gameplay outcomes do not guarantee future outcomes.

A previous:

  • win;
  • loss;
  • sequence of wins;
  • sequence of losses;
  • dry spell;

  • multiplier;
  • high RTP period;
  • low RTP period;
  • large win; or
  • other gameplay event

does not establish what will occur on a future spin or gambling event.

SpinVisor analytics should not be interpreted as a guarantee that any future gambling outcome will occur.

7. Historical Information Is Not a Prediction

SpinVisor may identify or display historical statistics, trends and observed gameplay activity.

Such information describes previously observed data.

It does not mean that:

  • a game is due to pay;
  • a win is due;
  • a loss is due;
  • a bonus is due;
  • a multiplier is due;
  • a losing sequence must reverse;
  • a winning sequence will continue;
  • a particular wager will succeed; or
  • a future result can be reliably inferred from previous results.

Historical patterns should not be treated as predictions.

8. Observed RTP

SpinVisor may calculate or display an observed RTP based on gameplay information recorded during a particular period, session or collection of gameplay events.

Observed RTP is not necessarily the same as the theoretical or published RTP of a game.

Observed RTP may differ significantly from theoretical RTP, particularly over shorter samples.

An observed RTP above or below a game's published theoretical RTP does not mean that the game is necessarily about to move toward the theoretical value during subsequent gameplay.

SpinVisor's observed RTP should therefore be understood as a historical statistical measurement of the applicable recorded sample.

9. RTP Does Not Guarantee Individual Results

A published or theoretical RTP is not a guarantee of the amount an individual user will receive during a particular:

  • spin;
  • session;
  • day;
  • week;
  • month; or
  • other period of gameplay.

Individual results may differ materially from theoretical statistical expectations.

SpinVisor does not guarantee that a user's results will converge toward a particular RTP within any particular number of spins or period of time.

10. Variance and Volatility

Where SpinVisor displays information relating to variance, volatility or similar statistical characteristics, that information is provided to assist users in understanding historical or game-related statistical characteristics.

It does not predict the timing or value of future wins or losses.

A period of unusually poor results does not mean that a compensating win is due.

A period of unusually strong results does not mean that similar results will continue.

11. Dry Spells

SpinVisor may calculate or display information concerning periods during which particular winning events or features have not occurred.

A dry spell is a description of historical gameplay.

It does not establish that:

  • a win is becoming more likely;
  • a bonus is becoming more likely;
  • a large win is due;
  • the user should increase a wager; or
  • the user should continue gambling.

12. Bonus and Feature Information

SpinVisor may track information concerning:

  • naturally triggered bonus features;
  • purchased features;
  • triggering spins;
  • spins before or after a feature;
  • feature purchase prices;
  • feature results;
  • feature progress;
  • multipliers;
  • awarded or missed multipliers;
  • feature totals; and
  • historical feature statistics.

This information does not mean that a future bonus or feature is due.

SpinVisor does not guarantee that purchasing a feature will result in a return equal to or greater than the feature purchase price.

13. Purchased Features

Where a casino game permits a user to purchase a bonus or other gameplay feature, the decision to purchase that feature is made by the user through the applicable casino or game.

SpinVisor may record and analyse the resulting gameplay information.

SpinVisor does not initiate the purchase and does not recommend that the user purchase the feature.

14. Profit and Loss Information

SpinVisor may calculate or display gameplay profit/loss information based on the data available to it.

Such information is intended to assist users in understanding recorded gameplay activity.

SpinVisor profit/loss information is not:

  • a bank statement;
  • an accounting statement;
  • a casino account statement;
  • a tax statement; or
  • an authoritative financial record.

Users should use official records from the applicable casino, payment provider, bank or other appropriate source where an authoritative financial record is required.

15. Analytics May Contain Errors

SpinVisor seeks to provide useful and accurate analytical information, but no software-based monitoring or analytics system can be guaranteed to be error-free in every circumstance.

Information may be affected by matters including:

  • unsupported games;
  • unsupported websites;
  • game updates;
  • casino website changes;
  • game-provider changes;
  • browser changes;
  • network interruptions;
  • delayed or incomplete events;
  • technical incompatibilities;
  • unexpected game behaviour;
  • extension interruptions;
  • software defects; or
  • other technical conditions.

Users should not assume that every value displayed by SpinVisor is infallible.

16. Casino and Game Provider Records Are the Source of Truth

SpinVisor analytics are not official casino account statements or authoritative game records.

Where SpinVisor-displayed information differs from information provided directly by the applicable casino operator or game provider, the casino operator's and game provider's applicable records and values are the source of truth.

This includes, where applicable, official information concerning:

  • account balance;
  • wager amount;
  • game outcome;
  • winnings;
  • game rules;
  • theoretical RTP;
  • bonus rules;
  • feature values; and
  • settlement of a wager.

17. Game Metadata

SpinVisor may display information concerning games and providers, including information such as:

  • game title;
  • provider;
  • theoretical RTP;
  • volatility;
  • maximum-win information; and
  • other game metadata.

Such information may originate from game providers, casino operators, publicly available information or other appropriate sources.

Game configurations can vary between operators, jurisdictions and versions of a game.

Users should verify applicable game rules and configuration through the casino operator or game provider where necessary.

18. Community Information

SpinVisor may provide community or aggregate information concerning matters such as:

  • game activity;
  • observed gameplay statistics;
  • game trends;
  • provider activity;
  • large recorded wins;
  • bonus or feature activity; and
  • other aggregated or community-derived statistics.

Community information describes observed activity within the applicable SpinVisor dataset.

It does not establish what an individual user is likely to experience.

19. Big Wins

SpinVisor may display large wins recorded through SpinVisor or shared through eligible community functionality.

Large wins are not representative of guaranteed or typical results.

Displaying a large win does not mean that:

  • another user is likely to achieve the same result;
  • the applicable game is currently more likely to produce a large win;
  • a particular casino is more likely to produce a large win;
  • a user should play that game; or
  • a user should increase their wager.

20. Activity Trends

SpinVisor may display recent activity or historical performance information concerning games or providers.

Terms and visualisations describing activity should be understood as analytical descriptions of observed data.

They are not predictions concerning future game outcomes.

SpinVisor does not represent that increased historical activity or observed performance makes a game more likely to produce a future win.

21. Community Data Does Not Represent the Entire Gambling Market

Community statistics may be based upon gameplay information available within SpinVisor's dataset.

That dataset may represent only a subset of:

  • players;
  • casinos;
  • games;
  • providers;
  • countries;
  • sessions; or
  • gameplay events.

Community statistics should therefore not automatically be interpreted as representative of the entire global gambling market or all users of a particular game.

22. Supported Casinos

SpinVisor may provide information identifying casino websites on which SpinVisor's technical functionality is currently supported.

A supported-casino listing means that SpinVisor has identified the website as technically compatible with applicable SpinVisor functionality.

It does not constitute:

  • a recommendation to gamble;
  • an endorsement of the casino;
  • a guarantee that the casino is appropriate for a particular user;
  • a guarantee concerning withdrawals;
  • a guarantee concerning game fairness;
  • a guarantee concerning the casino's conduct; or
  • a representation that gambling with that operator is lawful for every user in every jurisdiction.

Users remain responsible for determining whether an operator is appropriately licensed and lawful for them to use.

23. Unsupported Websites

Where SpinVisor is opened on a website that is not currently supported, SpinVisor may inform the user that extension functionality is unavailable and provide access to information concerning supported websites.

SpinVisor will not intentionally represent an unsupported website as technically supported.

24. Casino Legality and Licensing

Gambling laws differ between countries, states, provinces and other jurisdictions.

SpinVisor does not provide legal advice concerning whether a particular user may lawfully gamble with a particular operator.

Users are responsible for complying with laws applicable to their location and circumstances.

Where appropriate, users should verify an operator's licensing status through the relevant gambling regulator or other authoritative source.

25. SpinVisor Is Not a Casino Operator

SpinVisor does not operate the casino games monitored through the Service.

SpinVisor does not control:

  • random-number generation;
  • casino game outcomes;
  • casino account balances;
  • wager settlement;
  • casino deposits;
  • casino withdrawals;
  • casino bonuses;
  • casino promotions;
  • casino KYC procedures;
  • casino payment processing; or
  • casino account restrictions.

Questions or disputes concerning these matters should be directed to the applicable casino operator and, where appropriate, the relevant regulator.

26. No Guarantee of Casino Conduct

Technical compatibility between SpinVisor and a casino website does not mean that SpinVisor or Dynemetry (Pty) Ltd guarantees:

  • the casino's solvency;
  • withdrawal processing;
  • customer service;
  • regulatory compliance;
  • game fairness;
  • promotional terms;
  • account treatment;
  • payment practices; or
  • other conduct of the casino operator.

SpinVisor and casino operators remain separate services unless expressly stated otherwise.

27. Gambling Losses

Users can lose money when gambling.

SpinVisor does not guarantee that using its analytics will:

  • reduce gambling losses;
  • produce gambling profits;
  • improve gambling results;
  • identify winning opportunities;
  • overcome a game's mathematical advantage;
  • predict random outcomes; or
  • make gambling financially sustainable.

A gambling loss does not, by itself, establish that SpinVisor's analytics were defective or inaccurate.

Nothing in this section excludes liability that cannot lawfully be excluded.

28. Gambling Is Not an Investment Strategy

Gambling should not be treated as:

  • an investment;
  • a reliable source of income;
  • a savings strategy;
  • a method of paying debt;
  • a method of recovering previous gambling losses; or
  • a guaranteed means of generating profit.

SpinVisor analytics do not change the underlying financial risk associated with gambling.

29. Do Not Chase Losses

Previous gambling losses do not make a future win due.

SpinVisor statistics should not be used as justification for:

  • increasing wagers to recover losses;
  • continuing to gamble until losses are recovered;
  • borrowing money to gamble; or
  • spending money required for essential living expenses.

30. User Responsibility

Users remain responsible for decisions concerning:

  • whether to gamble;
  • where to gamble;
  • how long to gamble;
  • what amount to wager;
  • whether to stop;
  • personal gambling limits; and
  • compliance with applicable gambling laws.

SpinVisor provides information to assist users in understanding recorded gameplay. It does not make these decisions for them.

31. No Financial, Legal or Medical Advice

SpinVisor analytics do not constitute:

  • financial advice;
  • investment advice;
  • legal advice;
  • medical advice;
  • psychological advice;
  • addiction treatment;
  • debt counselling; or
  • professional gambling counselling.

Users requiring professional assistance should consult an appropriately qualified professional or relevant support organisation.

32. Responsible Gambling

Users should gamble only with money they can afford to lose and should establish appropriate limits concerning:

  • money;
  • time; and
  • gambling frequency.

Users experiencing difficulty controlling their gambling should stop gambling and consider appropriate support, blocking or self-exclusion services.

Deleting or uninstalling SpinVisor is not the same as self-excluding from a casino or gambling service.

34. Self-Exclusion

SpinVisor does not operate casino self-exclusion programmes.

Closing a SpinVisor account does not automatically close or restrict casino accounts.

35. Age Restriction

SpinVisor is intended only for persons aged 18 years or older.

A date of birth is required during registration for age-eligibility purposes.

A person who provides a date of birth indicating that they are under 18 will not be granted normal SpinVisor account access.

SpinVisor does not currently perform government-identity-document age verification and therefore cannot guarantee that every person attempting registration has provided truthful age information.

Providing false age information violates SpinVisor's applicable terms.

36. No Guarantee That Analytics Prevent Gambling Harm

SpinVisor's tracking and analytics may help users understand their recorded gambling activity.

SpinVisor does not guarantee that:

  • displaying losses will cause a user to stop gambling;
  • displaying session statistics will prevent excessive gambling;
  • displaying historical information will prevent harmful decisions;
  • analytics will prevent gambling-related financial harm; or
  • use of SpinVisor will prevent problem gambling.

Users remain responsible for seeking appropriate assistance when gambling becomes difficult to control.

37. Technical Availability

SpinVisor does not guarantee uninterrupted or error-free operation.

Availability may be affected by:

  • maintenance;
  • software updates;
  • browser changes;
  • casino changes;
  • game-provider changes;
  • internet connectivity;
  • infrastructure outages;
  • third-party systems; or
  • circumstances outside SpinVisor's reasonable control.

Users should not rely upon SpinVisor as the sole record of their gambling activity.

38. Commercial Gameplay Telemetry

SpinVisor's business model may include the commercial use, licensing or sale of gameplay telemetry event data and statistical datasets to third-party gameplay-data or casino-industry organisations.

Such commercial telemetry may include information concerning:

  • games and providers;
  • gameplay events;
  • spin activity and outcomes;
  • wager values and statistics;
  • win/loss values and statistics;
  • observed RTP;
  • bonus and feature events;
  • multipliers;
  • casino or website context; and
  • statistical information derived from gameplay telemetry.

Commercial telemetry datasets supplied to such third parties do not include user-referenced or account-linked information.

In particular, recipients are not provided with:

  • SpinVisor handles or nicknames;
  • pseudonymised or anonymised handles;
  • SpinVisor account or user IDs;
  • email addresses;
  • dates of birth;
  • IP addresses;
  • names;
  • profile photographs;
  • authentication information; or
  • other identifiers intended to associate gameplay events with an individual SpinVisor user.

39. No Individual Outcome Inference From Commercial Telemetry

The commercial use of gameplay telemetry does not mean that SpinVisor guarantees that aggregate or statistical information derived from that telemetry predicts an individual user's future gambling outcomes.

Statistical datasets remain subject to the limitations described throughout this Disclaimer.

40. Limitation of Disclaimer

Nothing in this Disclaimer:

  • excludes liability that cannot lawfully be excluded;
  • removes mandatory consumer rights;
  • limits mandatory privacy rights;
  • overrides applicable gambling legislation; or
  • prevents a user from exercising rights available under applicable law.

Where applicable law provides protections that cannot legally be waived or limited, those protections remain in effect.
